Ipoh High Court Judicial Commissioner Ridwan Ibrahim has disqualified himself from hearing a suit filed against Perak Speaker V Sivakumar by BN Mentri Besar Zambry Kadir and six executive councillors for suspending them from attending state assemblies.
Ridwan had controversially insisted that Sivakumar be represented by the state legal adviser, but last week the Court of Appeal overturned that ruling, allowing the Speaker to appoint his own counsel.
”Since his decision was reversed by the Federal Court, he thought it would only be proper for him to transfer the matter to another court,” said Zambry’s cousel Faizul Hilmy Ahmad Zamri.
The case was then moved to the court of Justice Wan Afrah Wan Ibrahim. She has fixed April 2 to hear an application from Sivakumar’s lawyers to strike out the suit.
Meanwhile, Ridwan is expected to again recuse himself when another suit filed by three BN-friendly independent assemblymen comes up for hearing. The trio had sued Sivakumar for declaring their seats vacant based on undated resignation letters they had previously signed.
Again, Ridwan had insisted that Sivakumar be represented by the state legal adviser. Sivakumar had objected to this on the grounds that there would be a conflict of interest as the state legal adviser was already advising Zambry in another case filed by Pakatan Rakyat Menteri Besar Nizar Jamaluddin.
Following this morning’s decision to recuse himself in the first case, Ridwan is expected to also disqualify himself in the other case.
